Terms of Use

1. Acceptance of Terms

By downloading, installing, or using any NOVAKU application ("App"), you agree to these Terms of Use ("Terms"). These Terms are a legally binding agreement between you ("User") and Novaku ("Developer", "we", "us", "our"). If you do not agree, do not use any NOVAKU app. We may update these Terms from time to time; continued use of any NOVAKU app constitutes acceptance of the updated Terms.

2. Description of Services

Novaku develops and publishes a suite of educational and entertainment mobile applications. Each app may offer free and premium tiers. Specific features and tier differences are described in the app-specific sections below (§A and §B).

3. User Accounts

3.1 Anonymous Use

NOVAKU apps operate without an account by default. Core features are available without registration, and your progress is stored locally on your device.

3.2 Voluntary Registration

You may optionally create an account via email and password or Google Sign-In. An account enables cloud synchronization of your data across multiple devices.

3.3 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly at novakuapp@gmail.com if you become aware of any unauthorized access to your account.

3.4 Account Termination

You may delete your account at any time (see our account deletion page). We may terminate or suspend accounts that violate these Terms without prior notice.

4. Premium Subscriptions

4.1 Available Plans

We offer the following subscription plans:

• History Pro — available within NOVAKU: History only.
• NOVAKU Pro — applies to all NOVAKU apps.

Pricing is displayed in-app and on Google Play and may vary by region.

4.2 Billing and Renewal

Subscriptions are managed through Google Play Billing and processed by RevenueCat. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. No payment-required free trial is offered.

4.3 Cancellation

To cancel, open the Google Play Store, tap your profile icon, go to Payments & subscriptions → Subscriptions, select the relevant NOVAKU subscription, and tap Cancel. Your access to premium features continues until the end of the current billing period.

4.4 Refunds

Refunds are processed by Google Play in accordance with Google Play's refund policy. We do not process refunds directly. To request a refund, contact Google Play support.

4.5 Subscription Restoration

Your subscription is automatically restored when you sign in with the Google account associated with your purchase, or by using the "Restore Purchases" option in the app settings.

5. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble any NOVAKU app.
• Copy, redistribute, sell, or sublicense app content without our prior written permission.
• Scrape or harvest content from the apps by automated means.
• Circumvent security features, access controls, or premium content restrictions.
• Use any NOVAKU app for fraudulent, deceptive, or illegal purposes.
• Upload malware or otherwise interfere with app infrastructure or servers.
• Attempt unauthorized access to other user accounts, backend systems, or stored data.

Violations may result in immediate termination of your access and, where appropriate, legal action.

6. Intellectual Property

6.1 Ownership

All NOVAKU apps, names, logos, UI designs, content, and materials are owned by or licensed to Novaku and are protected by applicable intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the NOVAKU apps for your personal, non-commercial use, subject to these Terms.

6.3 Educational and Game Content

Certain factual content (such as historical facts and general knowledge) may be in the public domain; however, Novaku's specific selection, curation, arrangement, quiz design, and presentation of that content constitutes original creative work protected by copyright.

7. Disclaimer of Warranties

We do not warrant that the apps will operate uninterrupted or error-free, that defects will be corrected, or that the apps are free from viruses or other harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you to the extent prohibited by law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Novaku shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of any NOVAKU app. In any event, Novaku's total cumulative liability to you shall not exceed the total amount you paid to Novaku in the twelve (12) months immediately preceding the claim.

EU residents: our liability is limited only to the extent permitted by mandatory consumer protection law in your country of residence.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict-of-law provisions. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Pamplona, Navarra, Spain, except where mandatory consumer protection laws of your country of residence require otherwise.
